Overview
This website and the LogM8 service are operated by Logm8 Ltd (“LogM8”, “we”, “us” or “our”).
These Terms of Service (“Terms”) govern your use of the LogM8 website, digital services, vehicle records, LogM8 keys, products and any other services provided by us.
By accessing or using the LogM8 website or services, creating an account, purchasing a LogM8 product, or using a LogM8 key to access a vehicle record, you agree to these Terms.
These Terms operate alongside our Privacy Policy, Shipping Policy and Refund & Returns Policy.
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you may have under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020, or any other applicable law.
1. Using LogM8
You may use LogM8 only for lawful purposes and in accordance with these Terms.
You must not:

Use LogM8 for an unlawful, fraudulent or misleading purpose.

Attempt to gain unauthorised access to another person's account or vehicle record.

Attempt to bypass or interfere with LogM8's security features.

Upload malicious software, viruses or other harmful code.

Use LogM8 to store or distribute unlawful, threatening, defamatory, abusive or otherwise prohibited material.

Interfere with the operation, security or availability of the LogM8 service.

Copy, reproduce, modify, reverse engineer or commercially exploit LogM8's software, website or intellectual property without our permission, except where permitted by law.
We may restrict or suspend access where reasonably necessary to protect LogM8, our users, our systems or the security of the service.
2. LogM8 Products and Keys
LogM8 products may include NFC-enabled stickers, labels, keys or other products that provide access to a vehicle's digital record.
A LogM8 key is intended to provide access to the vehicle record associated with that key.
You are responsible for keeping physical LogM8 keys in your possession or control secure.
If a LogM8 key is lost, transferred, sold with a vehicle, damaged or otherwise becomes accessible to another person, that person may potentially be able to access information associated with the relevant vehicle record, depending on the security and access controls applicable to that record.
You should contact LogM8 as soon as reasonably possible if you believe a LogM8 key has been lost, stolen, copied or accessed without authorisation.
3. Vehicle Records
LogM8 provides a digital platform for storing and accessing vehicle-related information.
A vehicle record may contain information including:

Service and maintenance records

Repair information

Receipts and invoices
-
Photographs
-
Documents
-
Vehicle information
-
User-added notes

Other evidence or information uploaded by users
Information contained within a vehicle record is provided by users and other contributors. LogM8 does not necessarily independently verify the accuracy, completeness or authenticity of information added to a vehicle record.
You should independently verify important vehicle, service, repair or maintenance information before relying on it.
LogM8 is not a replacement for professional mechanical, automotive, safety, legal or other professional advice.
4. User-Uploaded Information and Personal Data
LogM8 allows users to upload information and supporting evidence as part of vehicle service and maintenance records.
Uploaded information may include invoices, receipts, photographs, service reports, documents and other files.
Some uploaded files may contain personal, private or confidential information.
Your responsibility before uploading
You are responsible for reviewing information before uploading it to LogM8 and deciding what information you are comfortable making accessible to people who have access to the relevant vehicle record.
You should remove or redact any information that you do not want other authorised users of the vehicle record to see.
This may include:

Home addresses

Personal telephone numbers

Personal email addresses

Bank account details
-
Payment card information
-
Account numbers
-
Personal identification numbers

Other private or confidential information
For example, an invoice from a service provider may contain a customer's name, address, telephone number or other information that is not necessary for the vehicle's service history.
Users should consider redacting this information before uploading the invoice.
Access to uploaded information
Information uploaded to a vehicle record may be accessible to people who have authorised access to that vehicle record, including a person who has access to or possession of the relevant LogM8 key.
You should not upload information to a vehicle record that you do not want accessible to people who may have access to that record.
LogM8 cannot control what an authorised user does with information that they are legitimately able to view, including whether they download, copy, photograph, save or otherwise retain that information.
You are responsible for ensuring that you have the right or permission to upload any information, photograph, document or other material that you submit to LogM8.
Nothing in this section limits LogM8's obligations under applicable privacy legislation.
5. User Content
You retain ownership of content that you upload to LogM8.
By uploading content, you grant LogM8 the limited rights necessary to host, store, process, display, transmit and otherwise use that content for the purpose of providing and operating the LogM8 service.
You must not upload content that:

You do not have the right or permission to use.

Infringes another person's copyright, trademark, privacy or other rights.

Is unlawful or fraudulent.

Contains malicious software.
-
Is threatening, defamatory or abusive.
You are responsible for the content you upload and the information contained within it.
We may remove or restrict access to content where reasonably necessary to comply with the law, protect our systems or users, or enforce these Terms.
6. Vehicle Ownership and Transfer
A LogM8 record is designed to remain associated with a vehicle and may therefore be accessed by different people over the life of that vehicle.
You should not assume that information added to a vehicle record will remain private to you after you sell, transfer or otherwise give possession of the vehicle or its LogM8 key to another person.
Before transferring a vehicle or LogM8 key, you should review the information contained within the vehicle record and remove or redact information that you do not want accessible to a future owner or other authorised user, where the LogM8 service provides the ability to do so.
You are responsible for ensuring that you do not knowingly transfer access to a vehicle record to a person who is not authorised to access it.
7. Account Information
Where LogM8 requires you to create an account, you are responsible for providing accurate information and keeping your account details up to date.
You are responsible for maintaining the security of your account credentials.
You must notify LogM8 if you believe your account has been accessed without your permission.
You must not share your account credentials with another person where doing so would compromise the security of your account or the information stored within it.
8. Product Information
We make reasonable efforts to ensure that product descriptions, specifications, images and other information displayed on our website are accurate.
Product images may vary slightly from the actual product due to photography, manufacturing variations and differences between screens or devices.
If we identify an obvious error in product information or pricing, we may correct the error and, where necessary, contact affected customers.
Nothing in this section limits your rights under applicable consumer law.
9. Orders and Payment
When you place an order through our website, you are submitting an offer to purchase the selected products.
An order is accepted when we confirm the order for fulfilment.
We may decline or cancel an order where reasonably necessary, including where:

A product is unavailable.

There is an obvious pricing or listing error.

We reasonably suspect fraudulent or unauthorised activity.

We are unable to fulfil the order for reasons outside our reasonable control.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.
Payment is processed using the payment methods made available at checkout.
10. Shipping
Shipping and delivery are governed by our Shipping Policy.
We aim to dispatch orders within the timeframe stated in our Shipping Policy.
Delivery timeframes are estimates unless a specific delivery timeframe has been expressly agreed.
For international orders, customs duties, import taxes, GST, tariffs or other charges may apply depending on the destination country.
Unless otherwise stated at checkout, these charges are the responsibility of the customer.
Nothing in our shipping terms limits rights that cannot legally be excluded.
11. Returns, Refunds and Consumer Guarantees
Returns and refunds are governed by our Refund & Returns Policy.
Nothing in these Terms or our Refund & Returns Policy excludes or limits rights or remedies available to consumers under the Consumer Guarantees Act 1993.
Where a product fails to meet a guarantee under the CGA, LogM8 will provide the remedy required by law.
Depending on the circumstances, this may include repair, replacement or refund.
Our voluntary change-of-mind return policy is separate from your statutory rights under New Zealand consumer law.
12. LogM8 Digital Service
The LogM8 digital service may require an internet connection, compatible device, supported browser, NFC capability or other technical requirements.
We aim to keep the service available and functioning reliably, but temporary interruptions may occur due to:

Software updates

Technical failures

Internet or telecommunications outages

Third-party service interruptions

Cybersecurity incidents

Circumstances outside our reasonable control
We may update, improve or modify the LogM8 service from time to time.
Where an important feature or service included with a purchased LogM8 product is materially changed or discontinued, we will take reasonable steps to address the impact on affected customers where required by applicable law.
13. Accuracy of Digital Records
LogM8 provides a platform for recording and displaying information. It does not guarantee that information entered by users, mechanics, previous owners or other contributors is accurate, complete or genuine.
LogM8 is not responsible for errors in information supplied by users or third parties.
You should obtain independent confirmation of important information before relying on a digital service record for safety, mechanical, financial or other significant decisions.
14. Third-Party Services
LogM8 may use third-party providers for services such as:

Payment processing

Cloud storage

Email

Analytics

Authentication

Communications

Delivery and shipping
Third-party services may have their own terms and privacy policies.
We will take reasonable steps to select and use appropriate service providers, but we are not responsible for matters solely caused by a third-party service that are outside our reasonable control.
15. Intellectual Property
The LogM8 name, logo, branding, website design, software, graphics, text, images and other original materials provided by LogM8 are owned by or licensed to LogM8 and are protected by applicable intellectual property laws.
You may use LogM8's website and services for their intended purpose.
You must not reproduce, modify, distribute, sell or commercially exploit LogM8 intellectual property without our written permission, except where permitted by law.
16. Privacy
Personal information collected through the LogM8 website and services is handled in accordance with our Privacy Policy.
Because LogM8 allows users to upload documents and other information, personal information may be contained within vehicle records.
Users should review and redact information before uploading it where they do not want that information to be accessible to other authorised users of the vehicle record.
Our Privacy Policy explains how LogM8 collects, uses, stores, protects and manages personal information.
17. Security
We take reasonable steps to protect information held within the LogM8 service.
However, no internet-based system can be guaranteed to be completely secure.
You acknowledge that information transmitted or stored electronically may be subject to risks outside LogM8's reasonable control.
You are responsible for protecting your account credentials and physical LogM8 keys.
18. Suspension and Termination
We may suspend or terminate access to an account or service where reasonably necessary, including where:

You materially breach these Terms.

Your use of the service creates a security risk.

You use the service unlawfully or fraudulently.

We are required to do so by law.

Continued access is no longer reasonably possible.
Where reasonably practicable, we will provide notice before suspending access, except where immediate action is required for security, legal or operational reasons.
Termination of an account does not remove rights or obligations that have already arisen.
19. Limitation of Liability
To the maximum extent permitted by law, LogM8 will not be responsible for loss or damage caused solely by circumstances outside our reasonable control.
Nothing in these Terms excludes or limits any liability, right or remedy that cannot legally be excluded or limited under applicable law.
This includes rights and remedies available under the Consumer Guarantees Act 1993, protections under the Fair Trading Act 1986, and obligations under the Privacy Act 2020.
Where liability can legally be limited, it will be limited to the maximum extent permitted by law.
20. Fair Trading and Consumer Rights
LogM8 will not make representations or claims that are misleading, deceptive or otherwise prohibited by the Fair Trading Act 1986.
Nothing in these Terms is intended to mislead you about your legal rights.
If any provision of these Terms conflicts with a mandatory requirement of New Zealand law, that legal requirement will apply to the extent of the conflict.
21. International Customers
LogM8 sells products internationally.
Customers outside New Zealand are responsible for ensuring that products can legally be imported into their destination country.
International customers may have mandatory consumer rights under the laws of their country or jurisdiction.
Nothing in these Terms is intended to exclude or restrict mandatory consumer rights that apply to an international customer.
22. Changes to These Terms
We may update these Terms from time to time.
The current version will be published on the LogM8 website.
Changes will apply from the date they are published unless otherwise stated.
Changes will not remove or reduce rights that you have already acquired under applicable law.
23. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it lawful and enforceable where possible.
The remaining provisions will continue to apply.
24. Governing Law
These Terms are governed by the laws of New Zealand.
Any dispute will be subject to the applicable laws and dispute-resolution processes of New Zealand, subject to any mandatory rights or protections that apply to you.
